General Terms and Conditions (GTC) for the coaching program “better. with KayKay”

2. scope of application
These GTC apply to all contracts for coaching services concluded between KayKay GmbH (hereinafter “Provider”) and the customer (hereinafter ‘Client’) within the framework of the “better. with KayKay” program.

3. service description
The coaching includes individual training, nutrition and, if applicable, mindset consulting concepts, which are personally tailored to the client's goals. The services are mainly provided digitally, e.g. via e-mail, chat, telephone or app access.

4. support by the KayKay team
Clients are supported by KayKay and qualified members of its team. The client is not entitled to personal support exclusively from KayKay itself. All team members act on behalf of and within the framework of the standards of KayKay GmbH.

5. conclusion of contract
The contract is concluded by written confirmation (e.g. by e-mail or electronic booking). By concluding the contract, the client agrees to these GTC.

6. terms of payment
The coaching fees are to be paid within the framework of a monthly payment model, unless expressly agreed otherwise. The monthly installments are due in advance at the beginning of each month.
The client undertakes to set up and maintain payments via the payment system specified by the provider (e.g. SEPA direct debit, credit card or online payment service provider).
If the client is in arrears with a payment, KayKay GmbH is entitled to suspend the provision of services until the outstanding claim has been settled.

7. right of withdrawal
Consumers generally have a statutory right of withdrawal.
The client expressly agrees that KayKay GmbH may begin to perform the service before expiry of the withdrawal period. The service is deemed to have begun with the delivery of the individual coaching plans. A revocation is no longer possible from this point in time (§ 356 para. 4 BGB).

8. liability
Participation in the coaching program is at your own risk. It is recommended to check with a doctor before the start of the program whether there are any health concerns. The provider is only liable for intent and gross negligence.

9. contract duration and termination
The minimum duration is determined by the booked program. Premature termination is only possible in consultation with the supervising coach.

10. data protection
Personal data is processed exclusively in accordance with the applicable data protection regulations. Further information can be found in the privacy policy.

11. final provisions
Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
